Renovations, additions, and new buildings, do you know the necessary documentation? The complete guide to building permits, which are essential for carrying out regular work.

A building permit is an authorization issued by the competent authority, usually the Municipality in which the property is located, necessary to carry out building work in the area. It ensures that the construction, renovation, demolition and reconstruction of buildings and structures comply with current urban planning, construction and safety regulations. 

The relevant legislation is mainly regulated by the Consolidated Building Act (Presidential Decree 6 June 2001, no. 380) and subsequent amendments and additions. Among these, we remember the legislative decree 222/2016, known as the “SCIA 2 decree” which made significant changes with the aim of simplifying and rationalizing administrative procedures in the field of construction, reducing bureaucratic burdens for citizens and businesses.

TYPES OF BUILDING PERMITS

  • Building permit (PDC)
    The qualification to be requested from the Municipality for the implementation of interventions of urban and building transformation of the territory, such as new construction interventions, significant additions, major renovations and other significant modifications. It requires a complex procedure that involves the presentation of detailed projects and verification of conformity by the municipal technical offices. The PdC must be presented to the One-Stop Shop for construction which, within 10 days, must communicate to the applicant the name of the Procedure Manager who must process the application within 60 days.
  • Certified Report of Start of Activity (SCIA)
    The building practice to be started when the intervention involves the structural parts of a building, such as extraordinary maintenance on the structural parts, restoration and conservative rehabilitation interventions and building renovations other than those that require a building permit.
    The SCIA allows work to begin immediately after the presentation of the necessary documentation, under the responsibility of the qualified technician.
  • The SCIA alternative to the building permit, or Super SCIA
    A qualification to be requested in the specific cases indicated by art. 23 of the Presidential Decree 380/01. In essence, these are all those heavy renovation works, which do not involve the total demolition of the existing building, even if they involve changes to the space, elevations and changes in the intended use. The Super SCIA is a simplified procedure that allows companies to submit the application more quickly, electronically and without having to provide additional documents.
  • Communication Commencement of Work Affirmed (CILA)
    A qualification necessary to carry out work on a property, without however modifying its supporting structure: the so-called “light” maintenance work. Regulated by art. 6 bis of Presidential Decree 380/01, represents a communication sworn by a technician qualified as an architect, engineer, surveyor or industrial expert which contains the details of the work to be carried out.It must be presented by the interested party – owner, tenant, and in general anyone who has a real right on the property – to the One Stop Shop for Construction and allows the start of the work following the registration of the practice, without waiting for authorizations.
  • Free Construction
    Includes all interventions that do not require the start of a building practice and the communication or request for authorization to the Municipality, such as ordinary maintenance interventions, interventions aimed at eliminating architectural barriers, and finishing and paving works or external spaces, as long as they fall within the limits of the permeability index.

The SUPER SCIA alternative to the PdC and the building permit are building practices that require the payment of a contribution to the Municipality; CILA and SCIA (with the exception of SCIA for restructuring) however do not imply the payment of charges.

WHERE TO REQUEST THE BUILDING PERMIT

To acquire the building permit it is necessary to submit the relevant application to the One-Stop Shop for construction, or send the application online.
The time required for authorizations varies depending on the work you intend to do and the checks on the structure.

More precisely:

  • For the SCIA, being a self-certification signed by the technician, it is mandatory to attach any plant project or structural deposit presented to the region.
  • The CILA must be registered by the Municipality of residence and must also include technical and photographic documentation of the work that you intend to carry out.

For both the SCIA and the CILA, in addition to these documents, the name and details of the company you are contacting must be added.

WHO ISSUES BUILDING PERMITS

The qualifications are issued by the manager or responsible person of the competent municipal office in compliance with regulations, laws and urban planning instruments.
